Can you request a forfeit of collateral as apposed to a court date if one is not issued to you?

I received a citation for fare evasion in Maryland and received a court date but I am moving out of state and the court date is after I move. I was wondering if you can request a forfeit of collateral if one is not issued directly to you?

You may be able to do so (I am not sure), but you do not want to. This is a criminal offense that goes on your criminal record. You do not want to have a criminal record.

If your citation is a "must appear" you cannot forfeit collateral. You must appear. However, there are things that a lawyer can do for you which could eliminate the need for you to appear in court. Sometimes the State is willing to resolve maters before court. You should speak with a lawyer ASAP. Also, I don't think it would be in your interest to have something like this on your record in that it is sometimes looked at like a theft charge. You need to be very careful.

I think you must be talking about forfieting the bond money you put up to get out of jail. That is not all that would happen, a warrant for your arrest would be issued, and you could perhaps be extradited.

I'd need more details, this could be a "must appear" depending upon how it's charged. Either way, if this is in Montgomery County it's likely a good lawyer could work this out with the State's Attorney in your absence.

In Montgomery County, there's a good chance a lawyer can arrange matters so the charge can be resolved by community service performed in the location whee you are moving to, and get the case dropped. There is no forfeiting collateral, like some charges in DC. This is more like a theft crime. You do not want this on your record, but it is eligible for expungement if you have it handled properly.
