My neighbor was let go and thinks its all because his coworkers don't like him being gay. he was at his delivery driving job almost 5 years. He wants to bring an action to get compensation. Does he have any chance? I told him gay is not one of the buzz words for compensation. he is real mad and wants to do something. is there any thing he can do?
He might have a claim depending on more facts, when did this happen, where, etc. I suggest having a free case evaluation with an employment / discrimination attorney so all the facts can be gathered and his options exaplained. This types of cases have a much shorter time frame to file a claim.
You are correct in stating that sexual orientation is not one of the buzz words protected under the federal law. However, cities and counties have the ability to create additional protected classes. Therefore, it is possible that your friend's employer violated a local law by terminating him. Have your friend contact a Florida employment lawyer to further discuss his case.
It is impossible to say how strong your neighbor's case is based on your posting. I would recommend that he hire an employment lawyer to discuss this matter.

I'm so sorry for your neighbor! Certain states provide explicitly for recourse under the law for sexual orientation. Unfortunately, as the lawyers below point out, Florida is not one of them. However, I would suggest meeting with an attorney to see if there is another way to seek justice for your neighbor. Additionally, if your neighbor was let go because he was a man who expressed himself in a way that is not considered "manly," he may have a claim. Gender expression and identity are protected under Title VII. As indicated by several of the attorneys already, more facts would go a long way towards determining if, in fact, he has a cause of action against his employer. Again, I suggest your neighbor speak with an employment attorney to know the best possible options. Good luck to your neighbor.
Broward prohibits sexual orientation discrimination. He needs to contact a lawyer to navigate these waters and have the best chance of receiving any compensation. Tell him to reach out to a lawyer of his choosing. Best of luck.
