( Information will not fit in the allotted space) do I just type Addendum at the top of a paper and wright the additional information? May redeem my car, after I file the bankruptcy can I stop the car payments or do I have to continue paying the car payments if I want to redeem the car. Also car has shut off devise if payments are not made can they shut it off.
If you want to redeem, the process is to file a motion with the court. The motion should contain an appraisal of the vehicle and a mechanics report indicating the cost of any necessary repairs. You will need to obtain a hearing date and usually you need to attach a proposed order to your notice of the hearing, which must be served on the vehicle lender. Unless you have the cash in your pocket, you will need a lender. Lenders often have attorneys that can easily handle the redemption for you for a modest amount, and the ones I know will even finance the legal fees into your new vehicle loan.
