Where does it say that a cop who is there to make a report of my accident, has no right to give me a ticket and with no proof?

While you are answering the 1st question, I have a clean driving record from the day I started driving. But Mr. Cop has the right to call me a careless driving? For all the people going through the same situation as I am, don't back down! You have rights! I am a victim of a car accident who's total bill was $4000 of repairs. "Are you sure Mr. Policeman that you really want me to sign a Citation and call me a Careless Driver?" Do I need this stress?

So it sounds like you were involved in an accident and the officer that showed up to the scene determined that you were at fault and issued you a ticket. This happens often and there is nothing legally wrong with it. He is basing the ticket on the information at hand (the scene, statements, etc.) That said, these types of cases can be defended. Consider hiring an attorney to represent you.

I gues where it is said is by you, here. Get an attorney on your side when you are charged with a crime or a ticket.
