Can I remove visitation if the noncustodial parent is not complying with the visitation order?

noncustodial party has been in and out of the child's life for the past 8 years, taking me back to court every other year to modify visitation, and then will only exercise visitation rights for a few months before stopping. His inconsistency has affected the family structure between me & my daughter, and has caused behavioral issues in my daughter (acting out at home, public, and in school). After being absent for a whole year, the father requested visitation and has only complied for 7 months & has gone 7 months now without visitation. I have sole legal and full physical custody now. I'd like to remove visitation until our daughter is in high school and can decide for herself whether or not to re-establish a relationship with her father. Is this something I can do?

You cannot "remove visitation". If your daughter is having a tough time, it is not solely because of this. Therapy is the solution.

You cannot remove visitation if there is a current order. You can however file a Request for Order to Modify the Visitation. Consult with an experienced family law attorney.
