What do I do about minor in possession of alcohol
Anonymous2 views4 answers
I'm 17 and I went to a beach for my friends birthday party. They decided to bring alcohol but I never even touched any of it, I do not drink. My friend was lighting fireworks which resulted in the cops showing up to where our things were in the beach. I was away from the campsite out climbing on rocks and I heard the cops showed up so I went back to the camp. When I arrived back at camp I grabbed a water out of a chest which also had alcohol in it. Everyone else said they didn't know who's chest it was (it was really one of theirs, they were lying). The officer then said that I showed ownership of the cooler therefore it must be my cooler and gave me a misdemeanor. I begged for a breathalyzer to prove I wasn't drinking. I have to go to court, what do I do?! Will it expunge when I turn 18?
Find an attorney. If you (or your parents) can't afford one, a public defender will be appointed for you. Depending on your record, there is a chance that you'll be offered a pre-file diversion program. If not, this will likely be handled in juvenile court. The good news is that delinquency records will be sealed assuming you are terminated successfully. The bad news is that you don't get a jury and the process can be quite frustrating. Assuming you have a clean record, my guess is your case will get adjudicated either by: 1) a pre-file diversion program, 2) a post-file motion under WI-654, or 3) a DEJ. Either way, this is not a DIY project.
Good luck!
