My sister filled a police report against me for domestic assault ( which her claims are Very false). I have not yet gone to court to plead or answer to the said charges. She said in the police report that I threaten to burn her house down and I threaten her with bodily harm (which again this is false) I also have witness to this. Can I fill Libel - Defamation - Personal Injury against her? And if I can, where do I fill these criminal charges at, I live in Kansas City, Ks. and the police summon is in Joplin, Mo where she filled.

Since you do not know the extent or the content of her allegations, until you are contacted and confronted by the police, there is nothing for you to do right now. It may not go anywhere. Wait to see what transpires. If you are at all concerned, first hire a criminal attorney to respond to any charges; then if and when you are vindicated, then you should consider filing a defamation action. However, defamation actions are expensive.

Have you been charges or arrested yet? Just because she file a police report, doesn't mean that charges will automatically be filed against you. Stay away from her for awhile. You may need to get an attorney if the Prosecutor does file charges. Joplin is 150 miles away from KCK.
