N400 -- Filed with USCIS on Feb 11 2015 -- Chicago Field Office -- No Interview Scheduled -- Suggestion on Writ of Mandamus
Anonymous3 views3 answers
I have applied for US Citizenship on Feb 11 2015 and done with the finger printing on Mar 13 2015. My field office is Chicago and I haven't received the interview notice yet. I reached the congresswoman office about the status of case and I got the response that my case is stuck in the background check and there is no timeline committed about the completion of background check. I am from India. My record is pretty clean. I would like to know how many months does it take to complete the background. I understand that there is nothing to speed up the process. Currently Chicago N400 processing time is 5 months. I am already outside of their processing time. I would like to know how many months do I need to wait before I consider Writ of Mandamus (WOM). Please provide your suggestions.
Note that it is CIS policy to try to have the security checks completed prior to interview since there is 120 day rule for decision (unless waived) once interview is held. It is likely yours is just pending required security checks and will be issued interview when those are completed. If you have no record, there should be no concern except in the timing. If there is urgent need for review, a request for expedite considerations can be made, but those are still reliant on the security checks being completed. Hire an immigration attorney to communicate with CIS to find out if there is specific hold up or just local delays due to summer, retirements or vacation of government employees or other reasons for resources to be devoted elsewhere. Generally, we are seeing naturalization Applications being handled as expeditiously as possible, and that is why the general processing times are listed at 5 months (which is much faster than years ago).
