My business partner illegally signed my name as co-signor on a 11 different business loans. He used my house, above my signature that he forged, as collateral on these loans. We were general partners of an S-Corp in the packaging industry; I ended the partnership in 2011, he forged my signature on loan documents through 2013.

He can be charged with each separate event and he can go to prison. Talk to the prosecutor about the possibilities as this person's history also matters.

It is a crime under the California Penal Code for him to forge his signature as you say that he did. If we flip over to the civil side and talk about civil damages, you will need to show that you have suffered economic damage as a result of his acts. Obviously he has damaged you with wasting your time and efforts, but such burdens go unrecognized by the courts very often, unfortunately. My initial reaction is that there should be an intentional tort, but the specific one is escaping my mind. Maybe one of the other attorneys will come up with it. (I don't think you can get fraud since you didn't rely on his fraud; it was the creditor who relied on his misrepresentation.) In any event, he likely has little money to pay even if you were able to obtain a judgment against him for his damages, if any. I have attached the identity theft portion of the California Civil Code, which could become relevant if any of the creditors of this fraud come after you. Keep it on hand. You should seek a consultation with an attorney, so that a full and complete recommendation can be made to you after a review of all of the relevant facts. I hope this was helpful.

Make a complete written account of your story and attach every document you have and make several copies. One copy is for the police. Do NOT let them tell you this is a civil matter. Insist on speaking to a detective in the fraud division. A second copy is for your business or real estate litigator attorney who will have to file civil actions to clear title to your property and resolve other civil issues.
