It means the parent that has those charges against him could lose custody of his kids among other things. Friend, you need to retain an attorney sooner than later--this could be the beginning of a divorce.

This is the definition of the case given by the family law clerk: It means that a DV 100 application has been filed. Were you given notice for a hearing? Typically this is done on an ex parte basis. As there are children, the court will probably set a mediation date too. t

In the legal sense, domestic violence generally pertains to some kind of battery or assault on a spouse of co-habitant. Corporal injury to a Child pursuant to California Penal Code 273d, is the legal equivalent for abuse to a child. Prior to going to court, your attorney may be able to avert a filing by giving your side of the story to the police and prosecuting agency. This depends on the facts and needs to be done right away. If a case is filed then, at the first court appearance, you will want to enter a not guilty plea in order to have time to review all the police reports and conduct your own investigation. After you have an opportunity to review everything, then you will need to consider whether you want to enter a guilty plea or go to the trial on the case. If you plead guilty or go to the trial and are found guilty, the punishment can vary greatly. The punishment ranges from a misdemeanor conviction with no jail time to a felony with time in state prison. It really depends on the nature of the case. Contact an attorney right away.

It depends on if this is in criminal court or family court. Many attorneys don't know that there are different options and various things can be triggered. Do you have a "finding?" Did a court FIND that there was domestic violence? If so...then Family Code Section 3044 is triggered and there is a presumption that that perpetrator of domestic violence is a detriment to the child. In other words, it is not safe for the child to be with that person, and therefore this person is usually on supervised visitation and cannot have joint legal/physical custody. I would need more information.
