Civil Case - Acknowledgment of Satisfaction of Judgment: The Judge set aside the Acknowledgement of Satisfaction of Judgment,

Business 2 views 4 answers
but I wasn't noticed regarding his intentions- Is this normal??? I am the Plaintiff, and upon receiving proper funds from the judgment debtor, I filed the Acknowledgment of Satisfaction of Judgment with the court, and everything was fine, but now the clerk said there are unpaid court fees owed by both parties, so she asked the judge to set it aside. Is this proper?

There was a fee waiver. When you filed the lawsuit, you did not pay the court filing fee and other costs. You need to pay them.

If you had a fee waiver, then you probably need to pay that fee to the court, from the funds you received from the defendant. Consult an attorney on this, there may be more to it than your posting indicates. As for the judge's intentions, the issue may be the unpaid court fees. I am not sure why the defendant owes court fees, if you obtained a default judgment. Need more facts and you should consult an attorney with the complete case file.

Look at the court file and contact the clerks office to find out the requirements. If it is a clerk issue they may be able to help. Otherwise set and serve an ex parte. The adverse attorney may be able to help as the want the judgment satisfied.
