Should I settle or persue?

Business 3 views 6 answers
3 years ago, I was involved in a car accident as a passenger in a friends car. I suffered a 4 inch laceration from the top of my head to an inch into my forehead, I also suffered a couple of herniated disks. There has not been one day since this that my back has not cause me really bad pain. Long story short, my lawyer called me today and told me that they have made there first offer of $12,500 not including the lawyers cut. My lawyer advised me to take it but I don't think I should. The car had liability insurence so it was insurered for $25K. if someone could please give me some advise it would be greatly appreciated. Thank You!

You should speak with your attorney and ask him why he is advising you to take the offer. Were there other parties who were injured in the accident? Was a claim made against the vehicle you were a passenger in for its SUM/UM Benefits (only would apply if it exceeds the at fault vehicle's insurance policy)? Is there a scar from the laceration? There to many other questions to ask as well. The bottom line though is that your attorney is the one in the best position to advise you on this matter. However, that being said, I have never seen an insurance company offer their top value on a case in their first offer. Good luck.

First and most importantly, make sure your attorney has filed suit if it has been 3 years. If not, you will not be able to pursue your claim at all. Although the information you provide is limited, in order to accept such a settlement for the injuries you describe, your attorney should give you real convincing reasons. If he or she cannot, you might want to get a second opinion before agreeing to anything. This is your only chance of getting monetary compensation for what may be lifelong injuries. Make sure you are well informed.

I agree with Mr. Pascale. First, your attorney is in the best position to answer the question. Second, it is unlikely that the insurance company has topped out on its initial offer.

I would sit down with my attorney and ask him to explain why you should not pursue the entire policy. there are many factors that can contribute as to why your attorney is advising you to take that amount. How many parties are suing the defendant? Who is the insurance carrier? What is the liability of the defendant or defendants in this case? You are entitled to ask and have all your questions answered. Good luck
