Is there any way to speed up getting satisfaction of judgement from law firm?

Business 5 views 4 answers
I am purchasing my first home. In order to close I had a judgement that needed to be paid. I paid the judgement in June and have been waiting for the law firm to send me the satisfaction of judgement. I explained my situation but they didn't seem to care and told me it could take 30-60 days. We have already pushed our closing back a few times because of this. Is there anything legally I can do in order to get this process sped up? Or am I just at the mercy of a heartless law firm that doesn't care once they have their money?

File a motion with the court with notice to the firm asking that the judgment be vacated and the case dismissed on the ground that you have paid the judgment. You are entitled to this under Illinois law. You have to give about 7 days notice. Attach proof of payment.

I would go directly to the court where the judgment was entered. If it is District Court, there is a form you can submit. You can even just check with the clerk of the court to see where your Satisfaction of Judgment is and why it has not been entered. Ask the clerk of the court to pull your file and make sure the law firm you hired did submit something. Explain to the Clerk your problem and that you need the satisfaction ASAP. Also, give your closing company proof that the debt has been paid. Sometimes, that is all they need.

If your judgment has been paid in full, it does not take 30-60 days for a release to be prepared and filed. The release and satisfaction of judgment takes about five minutes to prepare. This is something you actually can do yourself if necessary by securing a copy of the form if available through the clerk of the Circuit Court or by going to a law library and looking for samples. File a motion for entry of a release and satisfaction and to vacate the judgment and send notice to the law firm. Present your paperwork and proof of payment to the judge and get an order entered that will satisfy your needs for home purchase. You can bring a certified copy or original Release and vacating the judgment to your real estate attorney for presentation at closing. Your will lender may need to see proof of satisfaction in advance so be prepared to send a copy to your lender if necessary but keep the original which may have to be recorded by the title company if required by the lender. Hopefully you have an attorney for your real estate transaction.

Ask your real estate lawyer to find out from the title company if they will issue an endorsement to protect the mortgagee who is lending you the money to buy the home. If you paid the debt and have proof of payment, they should issue the endorsement for a reasonable premium or perhaps no premium payment at all. That way your lender is protected and you can close and not have to wait for the satisfaction.
