Real estate attorney AND title company?

Business 6 views 4 answers
I am a first time home buyer. I hired an attorney to represent me during the attorney review process. She is doing all the due diligence, title search, survey, etc. Do I also have to hire the services of a title company to assist me in the closing? Or does the fact that I already retained an attorney to perform the due diligence is sufficient? Thank you!

If you retain an attorney to assist you, he/she will handle the legal aspect and order the title search through the title company. However, the title company's role would be limited to providing the search and issuing the title policy post-closing. The attorney would handle the other aspects of the transaction, including the closing. Good luck.

Under the new Federal Consumer Protection Bureau (FCPB) rules that go into effect this fall, New Jersey closing procedure will undergo a significant change. With some lenders, the rules will go into affect before the October 1st deadline. NJ, like most of the country, will move towards title company closings. Thus, you may pay for an attorney to negotiate your contract and home inspection issues and also pay for a title company to close the mortgage and title.

A title company will still be involved, but the attorney will handle that and whether or not the attorney does your closing or the title company does, will be spelled out in your contract with the attorney. (normally the attorney will do the closing and the title company will do the title search and certify good title).
