On the Separation Agreement, how is it legally interpreted?

I am filing out a Separation Agreement in Colorado pro se with my ex and would like some help on what this means legally. I have pasted the language from the form below: "Both parties agree to the terms of the following Maintenance Agreement: 1. Petitioner shall pay maintenance to the Co-Petitioner/Respondent. 2. The Payments will be twice a month in the amount of $ 500.00 ." What does the amount on line "2." represent? Is it ( A. ) OR ( B. )? (A) $500.00 Divided by 2 = $250.00 OR (B) $500.00 Multiplied by 2 = $1,000.00 I would appreciate feedback on this as we need to file this very soon. Thanks for you time and have a great day.

Hello, I am not quite sure what you are asking. A determination maintenance is calculated baaed on many factors. If you agreed on $500 a month then you can spread the payment out or require one monthly payment. If you agreed to $1,000 a month maintenance then same applies. The question is what is your agreed monthly amount of maintenance?

With all due respect ma'am, what you ought to do is bring the forms into an experienced family law attorney's office, buy an hour's worth of time, and make sure things are done right. I know those forms inside and out and I can tell you that they can be a bit tricky. No one can tell you exactly how to fill out the section you have requested because no one can see the document in its entirety!!

Most of us who practice family law spend a fair amount of time attempting to correct the errors that pro se parties make. In some cases, it is too late and substantial rights (and money) are lost. The best approach is to consult with a family law attorney before anything is finalized to make sure you understand what you signing.
