Pursuing criminal charges/ damaged property

Criminal Charges 9 views 7 answers
I filed charges against a friend last night for shoving me and attempting to hit me, and then taking my phone out of hand as I was attempting to call 911 and destroying it on the concrete. What is the process for me to get paid for my completely damaged phone?

The court could order restitution for the cost of your phone. Otherwise, you have the option of pursuing a claim in civil court.

You may have made a police report - that doesn't mean that you "filed charges". Only the prosecutor's office can file criminal charges. Assuming they they do, if there is a conviction, the defendant will be required to pay restitution for any damage they caused. You can also file a small claims case against them and pursue it that way.

With friends like that, who needs enemies? Once your buddy is convicted (if ever and months from now), you can request restitution. In the meantime, may I suggest that you buy a new phone and perhaps find a way to work this out with your "friend?"

If the accused agrees to pay you restitution or is otherwise ordered to do so, then he will; all you have to do is prove your loses to the prosecutor.

If your friend is convicted, the court will order restitution for your damaged phone. Let the prosecutor know that you are seeking restitution for the damaged phone.
