Can I ask for a dismissal for my traffic ticket because court "failed to appear?"

2 views 5 answers
I took the day off from work to appear in traffic court on the date my citation stated. After an hour or so of getting the run around, I was told that I was not on the docket because the court was approximately "three months behind in their paperwork". I would be getting a courtesy notice sometime in the next two or three months "tops". I was given an "attempt to clear citation" paper by the clerk and sent on my way. I finally got the courtesy notice, but I feel that this ticket should be dismissed because, after all, if I had not shown up because I was three months behind i would have been given an FTA. I already lost one days pay, and really cant afford another one (or two). It isn't my fault the court is bogged down in paperwork. I did what I was supposed to do. Thanks

You can certainly ask but don't expect any relief from that request.

I agree with Mr. Wolf. You may even ask the judge to sing Happy Birthday, but don't surprised when the answer is NO.

Most respectfully, no. I understand your frustration, but this is a situation that often arises and I have never seen such an argument work, let alone made. Our system is not perfect.

Unfortunately the answer is no. You may request a different day, through the clerk's office, so you can plan accordingly and not miss any more work.

The Court can continue matters on their own. You can't get matters "dismissed" because it was an inconvenience to you. How about you go to traffic school if it is not too late or if you are eligible? Why are you fighting something where you can have a favorable disposition, i.e. winning and not having it on your DMV record?
