I have a simple assault charged on me as does my boyfriend. It's the first time it happened, what should we do?

the other day my boyfriend and I(we live together with my parents) were drinking and got into a fight over us taking a break. He tried to walk away from the situation but I got mad and went after him first. It started with yelling and ended up with us hitting each other, me attacking him first and him fighting back in self-defense. He only called 911 cause he thought i was gonna hurt myself and now we both have simple assault charged against us. We didn't press charges but the state did. I keep reading that we may face jail time, which is what Im more worried about for the two of us. It was a fight that got a lil out of control. My dad wants to get a lawyer but he(the boyfriend) cant afford one. I'm really scared one of us will go to jail cause of this, isn't there anything else we can do?

First any information you post here on the internet can be used against you in court. You admitted here to starting the fight and hitting your boyfriend: Not Good. Second your Dad is right you need a lawyer as yes you can go to jail and if you keep defending yourself as you did here you definitely increase those chances. Third if you caused the fight as you said you morally owe your boyfriend to help him hire a lawyer. Please note that you will both need separate lawyers. Fourth repeat step 3 GET A LAWYER you do not need a criminal record, if your father is willing to pay for it don't be _ _ _ _ _ _. The judge in Spotswood Judge Herman is not an "easy" Judge, fair but not "easy", but this case can be easy for a good lawyer to resolve favorable for you. Good Luck,

Each of you need your own criminal defense attorney! Chances are slim that either of you end up in jail if you have clean histories, no weapons wee used and no real injuries were caused. Good luck!

Best advice is both of you, is to obtain seperate lawyers. Although both of you are not charged with indictable offenses, these are still criminal offenses which yes, carry the potential of jail time, fines, not to mention you'll both have criminal records. However, Jail is probably unlikely under the facts you present, especially if it's a first offense. That said, consequences are nevertheless significant so you should take this serious and discuss your case with an experienced attorney as he should with another different attorney. If he can't afford an attorney, he should apply for a public defender. good luck.

Yes. Start anger management classes and bring proof to court. It can only help. It's possible that both cases could be dismissed, but it depends on the circumstances of the case, the prosecutor, and the judge.
