First, go to DMV and have your driver's abstract run. This should tell you where and how your license is suspended, and you can get to work on clearing the suspension(s). Bring proof that you have cleared the suspension(s) to court, along with your abstract. If you have dealt with all suspensions, you will possibly be offered a plea to a lesser offense and have to pay a fine. (You are probably currently charged with a misdemeanor, which is a crime. Do not take this lightly.) If the fine has to be paid to Albany, this can take time, so get to work on it ASAP. Do not drive until you are absolutely certain that your license is clear and valid. If your license was restricted, this could affect your ability to clear your license, and it could affect DMV's willingness to let you keep your restricted license. Driving with a suspended license is a misdemeanor. I have appeared at this court (99 Main St) many times so I am quite familiar with the process. On the first court date, you need to enter a plea (not guilty, of course) and then get a new date. The court will require you to clear up your suspension(s) prior to resolving the case. Usually, we can get the misdemeanor reduced to a violation if the suspension(s) are cleared. If you can clear up the suspension(s) before your first date, we may be able to resolve it then. A restricted license is generally given for a specific duration. However, even after that duration is up you must go and personally turn the restricted license in. If you don't, the restriction continues. The problem with a restricted license is that any violation you receive has the potential of suspending that license. You are not entltled to more than one restricted license in a 3 yr period. If the Offficer said you are suspended, there is the possibility he was reading the print-out wrong OR the restricted license was suspended for something. Driving with a suspended license is in the very least a misdemeanor and oten a felony. In order to better answer you, call my office for a FREE CONSULTATION Law Office of Terri B Kalker 718-275-0780

Many police officers charge incorrectly that someone is driving on a suspended license, which is a crime, instead of charging the appropriate violation of driving outside of license conditions, which is merely an infraction. I have made many successful motions dismissing the charge when this happens.
