Can I claim for damages to Leather chairs moved to patios by Tenants and carpets damaged by the children?

Tenant said Leather Chairs were moved out to patios because children need more space for toys. Said she did not call me to take chairs out of premises as she did not want to bother me. Told her her action in destroying the chairs is an ultimate disrespect for a Landlord's property. When presented with costs of replacements for damages after deduction of deposit still held by me, she says "I cannot afford to pay you this money so if you want to sue me in court, go ahead." Indicated to her that when I presented the letter with the costs of repair and replacements, I was open-minded and had hoped for a mutual negotiation. She again insisted "I cannot pay you this money, so go ahead sue me in court". I have no alternative but to proceed on this route.

There isn't really a question here. Your telling us that you have to sue your tenant which is what it sounds like you have to do. If they damaged your property and refuse to pay for it you'll have to sue them. Beyond that, is there a specific question you need answered?

There is not a question here. If you are seeking an attorney to sue your tenant then there are several landlord/tenant lawyers in the area. Some offer free consultations. You may also pursue the matter on your own in small claims and then possibly meet with an attorney to collect on the judgment through garnishment. You should make an appointment with one to discuss the facts of your case and see if it is worth pursuing.

You should consult with a landlord-tenant attorney because it's possible that, even if you receive a judgment, it will be impossible to collect.
