If you are paying for a car and the interest rate is high or the car is worth less than you owe on the car and either the loan is a non purchase money loan or a purchase money lien that is more than 2.5 years old, you may be better served by filing a chapter 13.
If you will to meet with an experienced bankruptcy attorney that handles chapter 7 and chapter 13 cases, you may find that the amount of money an attorney can save you is more than you will pay in attorneys fees and you can still keep the things you need. If a chapter 7 is the best option for you, some attorneys will allow you to pay them monthly and file the case once you have paid the fee. During that time, all collection agencies must stop calling you and most other creditors will stop as they know that contact is a waste of their time.
Most bankruptcy attorneys will meet with you at no charge for the initial appointment. You can use the "Find a Lawyer" link at the top of this page to search for an attorney.
The reasonableness of attorneys fees depends on your case. Some of us may charge you less than others and some more dependent upon the difficulty we believe that your case will be. You also are not clear as to whether you want to file for chapter 13 or chapter 7. If you are looking to file a chapter 13 case, most of the fees can be wrapped into the plan. If you are looking for chapter 7 please realize that $335 of the amounts quoted by the attorneys are for the filing fees to the court which no attorney is going to pay for you. If you are filing a simple chapter 7 case without many assets or debts an attorney may only charge you $700 or $800 but you must speak with the attorneys for them to decide whether it is a simple case. You should consult with a bankruptcy attorney as soon as possible. Most initial consultations are free.
Most people that pick a bankruptcy attorney by price will regret it. A cheap fee will provide you with limited service by the attorney while an unqualified clerk will do the work with minimum supervision. Everyone believes their case is easy, but an attorney that isn't careful can get you into hot water by failing to screen you for landmines that an attorney charging more will prevent. You need a question answered or a change made? If the cheap attorney provides you with this service, it is extra. Need documents when your case is over? The cheap attorney won't store records or may have left town. If $2,000 is too much for you, bankruptcy is not the right program for you & you probably don't have enough debt to obtain sufficient benefit from bankruptcy. If I could get you a guaranteed 10 times payout on any casino game, you'd be running to play with my strategy. Hope this perspective helps.
