Filed BK April of 2014, Discharged granted July 2014. A few creditors continue to report the accounts open or in collection.

All creditors were served by Certified mail by my attorney and the court I'm told. One creditor has attempted to collect debt after filing date and receiving a letter from my attorney. Another creditors changed the status of the account quarterly it seems. Yet another refused to correct their errors and close the account, also change the status from joint to individual (me) as the debtor. I don't wish to go back to my former attorney for he exposed me to a potential debt and told me it wouldn't matter. I was told not to ask questions "We know what they were doing" just to completed the forms. I did and was verbally abused by he and his staff for I have medical issues that prevent me from writing clearly, I've called these creditors and sent letters and filed disputes

You are not required to return to the attorney that handled your bankruptcy. There are some excellent bankruptcy attorneys in NC. Bankruptcy attorneys that are experienced in the handling of litigation against creditors for violation of the discharge order and for violation of the Fair Debt Collection Practices Act (FDCPA) are the attorneys that you need to retain. Many of them will agree to a contingent fee arrangement and/or collect their fees from the creditors. You can use the "Find a Lawyer" link at the top of this page to search for an attorney. I suggest you use the categories of Debt Collection, Debt Settlement, and Bankruptcy. Some attorneys that handle each of these areas will handle both bankruptcy discharge violations and FDCPA claims.

There are a number of fine bankruptcy attorneys in Charlotte who are experienced with dealing with Fair Debt and Fair Credit Reporting Act violations. Use the find a lawyer tab here on or at www.nacba.org to find one. Although the problem probably is with the creditor, I have seen times when the problem is actually the the credit bureaus' systems and even though the creditor is properly reporting th einfo to the credit bureau, the credit bureau will not make the correction.
