Husband needs a new criminal defense attorney
Anonymous10 views4 answers
he currently has an attorney but is looking for another because he's attorney has not done anything for his case. unfortunately he is out on an attorney bond. how does that affect obtaining another attorney if he does will he go back to jail while he waits for his case, he is facing a felony from aggravated assault with a deadly weapon and two counts of criminal misconduct. it was in self defense and the guy it was against is detained on a blue warrant going back to tdc for violating his parole. the guy has priors with burglary hab. as well as previous assault cases. please advise thank you
You are correct if you dump his existing attorney the attorney will get off his bond and he will need to bond out again. He is facing serious charges that have a potential sentence from 2-20 years. He needs an experienced San Antonio criminal defense attorney. Most like myself will offer a free consultation
Your primary question seems to be whether your husband can retain new counsel without having to return to jail, since he was bonded out by his current attorney.
The answer is yes. In other words, there is no reason why he should have to return to jail (because of bond revocation) when he fires his current attorney.
The key to avoiding such a situation is to be prepared before firing anyone. You should first try to find his new lawyer before you do anything else, since his new attorney can ensure a smooth transition. If he does bonds, then he can confer with the first attorney, and arrange to get a second bond approved before action is taken on the first bond.
If his new attorney does not offer bonds, then you should visit a bail bondsman to get a new bond submitted. Again, the new attorney can coordinate substitution of the bonds with the first attorney (and, if necessary, with the court).
I hope this addresses the concerns you had. I wish you the best of luck.

If he is on an attorney bond, he will have to make another bond if he changes lawyers. (If he is not satisfied with his lawyer, then it is better to change lawyers than it is to keep the lawyers just to keep the bond.)
I agree with Brent. My advice is do it now. Otherwise you be on again in a short time writing that he was convicted and sentenced and asking what you can do. Who is his attorney now?
