Should I be a co-applicant with my husband for his business loan?

After my mother passed away, I inherited some money. Two years later I married my husband , I borrowed him money to build his auto mechanic shop. I borrowed him the money from my inheritance money that I had invested with Edward Jones. No signed agreement was made between us. He is currently making payments to my EJ account, but we are also currently separated, not legally. I want him to get a loan to pay back my account. I am unsure whether I should be a co-applicant with him, cause it just seems that I am putting myself at risk if our marriage doesn't work. With Wisconsin being a 50/50 state, I look at it this way - I borrowed him the money, but if I co-app with him on this loan and we end in divorce I then become liable for half his loan which was my money in the first place.

You are correct, it does not sound like a good idea for you to co-sign any loan he places with a bank or anywhere else. As a co-signer or guarantor, you would be liable on the loan he placed, ironically to pay you back. You would not be merely liable for one half of the loan amount but the full amount due. If things are not as great as you suggest between the two of you, now might be a good time to have a consultation with a divorce/family law attorney who can then you general advice going forward to to place yourself in the best position possible. Good luck.
