Is Tenant Responsible for Damage Caused by Clogged Drain?

4 views 3 answers
My apartment management said I may be responsible for parts, time and labor caused by my taking a plunger to my drain as a result of a clogged sink. He said because I took the plunger to it, something I should not have done, caused water to leak into the apartment below. This was an innocent step on my part. Am I responsible for all costs associated with repairs?

It's not possible to answer "for sure" based on your question, but it sounds a bit ridiculous to me. Need to see lease and learn more facts. it would not be expensive for you to hire a local expert to communicate with your landlord and sort things out, one way or the other. You need lease and negotiation coaching, not legal advice. An attorney mediator who is a leasing expert can provide that for you.

If you are the one that caused the damage, then yes, you would be responsible for it.

The landlords position seems to be unreasonable. If you purposely caused harm, you should be responsible. However, attempting to plunge out a drain clog seems to be a reasonable step on your part. As in all cases, a complete review of all facts would be necessary to reach a firm conclusion. Good luck!
