Do I have any recourse from the damage to my leg, from a cyst being removed by the nurse, instead of the doctor?

I went to the doctor to have a cyst removed from right leg and the doctor had the nurse remove it. Now some time has passed and it has turned into a large hard black mass on my leg. The doctor refuses to see me as a patient, to fix the damage.

If the removal was not done consistent with good and accepted practice to remove such a lesion you may well have a cause of action. speak to local malpractice counsel to investigate.

Figure out what the new mass is, is it related to the old mass. Then explore your options. Nurses have gained exceedingly broad discretion in the last few years and Doctors equally have been allowed to delegate more and more with less and less supervision. You will need to speak with an attorney to determine if the nurse was acting within her scope or if the doctor can be negligent for delegating that task to her.

First off you need to have the black mass evaluated by a different doctor. Find out what it is. Without telling the other doctor what you believe the causation was, ask the doctor what he believes the causation was. That is your first step. The two could possibly be unrelated. The black mass could also be related to the self care post op. You have to prove that there was a connection between the cyst removal and the resulting black mass. It is also curious why the doctor will not see you. That is most unusual. Write the doctor an email and ask him why he will not see you. The purpose of this is to get in writing why your physician refuses to see you. As for the nurse. Many many doctors begin their medical career as a nurse. Nurses are essential and very skilled. You did not mention if the nurse was a surgical nurse an LVN or an RN. These things matter. Best together as much evidence as you can and see a personal injury attorney that deals with medical malpractice or medical negligence. We hope you're feeling better now!
