I just lost my work loss and medical claim from a MVA from 2013. My attorney states I need an appeal attorney. Who can I contact

MVA 9/2012 which the driver swerved into my lane and came to a complete stop. I went to ER next day and was told whiplash (not documented), but lower back pain and stomach problems were documented then 12/2012 was still having problems with neck & arm. I went off work 10/2013 due to herniated disks and surgery 4/2015 level 3 with plate. The jury reflected on a fall from 7/2013 which was from my arm being numb, but had no effect on anything other than my neck. How can I appeal this decision from 7/24/15? I know there's a limited amount of time and my current attorney states I need an appeal attorney, which he can't do at this time. Nothing was ever paid by my insurance carrier not even the ER. Now they want a letter stating I won't appeal. I will not sign until I know my rights to appeal.

Use find a lawyer feature to find local appellate counsel or have your present attorney recommend one.

You need to consult another personal injury attorney in your area right away. Make sure you have a copy of your entire file for him or her to review.

Mr. Wolf's advice is good. Ask your own lawyer. Since we cannot recommend individual lawyers on this forum, let me suggest two more alternatives: First, you might consider contacting your local county bar association's "lawyer referral service". I see that you are writing from Pontiac Michigan; I know for a fact that Oakland County (which encompasses Pontiac) has such a lawyer referral service. I myself used to be part of the Oakland County Bar Association, and previously served on its lawyer referral service committee. I no longer do, nor have I been among those attorneys who receive referrals from them (and have not, for years). Second, you might also consider contacting the Michigan Association for Justice in Lansing. This is the "trade association" group for attorneys who specialize/focus in the representation of persons injured in accidents. They have a few highly skilled attorneys to whom they regularly refer their appellate matters. While I myself am a member of the MAJ, I do not do appellate work, and probably would not be the best person to assist you. Between the Oakland County Bar Association Lawyer Referral Service, and the MAJ, you should be able to find someone highly skilled, pretty quickly. Please note that you do not have a lot of time. I believe the Court Rules give a party 21 days to appeal a final order, from the date upon which that order was issued. Sometimes, a verdict is issued by a jury, or a summary judgment order is issued by a Judge, but the order is not "entered" for a few days afterward. The calculation of these days maybe critical in your case, given that we are now at July 30, 2015, and your matter was heard six days ago. Good luck. Jon Frank Richmond MI
