What actions can I take to get access to my house?
Anonymous3 views6 answers
Hi, my dad left his house in trust to me and my sister. She is trustee, I am half beneficiary. She has locked me out and changed the alarm code so I cannot enter. How do I get into my house, and what actions can I take because I do not have a place to live now.
Get your Attorney involved and have him or her file a Motion to Compel the Trustee. See .com under the Search Engine entitled 'Find-A-Lawyer'. Enter Estate Planning and the City & State, and you'll see a list of competent attorneys in your area who can help. Good Luck on this..

Hello,
You may want to remind your sister that she has to follow the instructions in the trust. Advise her if she does not then you will retain counsel who will take action to insure that your rights are enforced.
The LA County Bar Association can provide you with attorney referrals who handle trust administration issues.
You should use 's Find a Lawyer feature or contact your local bar association for a referral because you need to get an attorney involved to help you receive your proper share. Good luck.
Your sister is not necessarily doing anything wrong. She may be preparing to sell the house and then give you your share. She is being contentious by not disclosing exactly what she is doing. If you want the house you can buy her out of her share if you have the resources. Did your sister retain counsel to help with the Trust Administration process? If so, I would be more inclined to say wait and see. If she has not, and she did not provide you with formal notice of death in the mail, then I would be more inclined to say start looking for counsel.
Can you buy your sister out? Were you living there before and she locked you out? She is not obligated to own property with you but she must follow the law. Speak with an attorney to discuss your rights.
