Can I kick my tenant out if he sublet my house to someone else, even if it is noted that he's not supposed to on the contract?

We rent two rooms to the tenant, the tenant sublet the house out to two families, one occupying a room, and he moved downstairs to the living room. Can I kick him out because he violated the contract?

It may depend on what the lease agreement states and whether there is still time left on the lease. If so, then the subleasing may be sufficient grounds to terminate the lease and evict him. Without seeing the lease, it is impossible to say whether a simple form will work in your situation. If the lease term already ran out, then you can terminate with 60 days written notice. You will have to evict him and all the other tenants. There are some complications and you obviously have a difficult tenant. Don't try to do this on your own. Hire a local landlord tenant attorney to make sure everything is done properly.

If the lease contains an absolute prohibition against subleasing, you can enforce and serve a three day notice to quit now.
