Can I sell my divorce settlement for a lump sum? if so to whom?
Anonymous2 views2 answers
If I get alimony and Child support ordered in my divorce, is there a way to sell that? not to sound superficial, I am just trying to cover my options.
When you win the lottery the offer you a larger sum in payments over time or a smaller lump sum up front, are their companies that buy divorce settlements like that? My still husband just quit his regular w-2 job and still hiding money in his DBA. I am wondering if i agree to a decent settlement that he can pay but I know I will be fighting for years to get it from him, is there somewhere to sell the settlement and move on so I don't have to worry about it? Does the thought process even make sense?

Famous “in theory”, you might be able to, but it would be highly speculative and you'd probably not find a buyer.
From what you say, the divorce is not settled. If you have these concerns and if your husband is doing what you claim, then you need to address those actions in any settlement or trial. If you husband is “hiding” assets then you and your attorney need to actively take steps to prove the same, and recoup those assets.
You had best find an experienced family law attorney, and start moving forward with “discovery“ and requiring production of documents.
Wow, that's a great question. I have no idea if there is a company that does this (never looked into it). You could check around the internet and see if you can find someone.
This said, I think it would be highly improper, if not downright illegal, to take a lump sum payout on child support. Utah law is very clear that child support is not yours (although you may receive it and direct its use) but your child's. Bartering away child support to a third-party is a recipe for disaster, civil liability, and potential criminal charges.
