Can I be fired due to my prescription drugs?

Business 2 views 2 answers
I was involved in a car wreck and the police report concluded that I was NOT at fault and that it was impossible for me to avoid the crash. I have a prescription that causes drowsiness and my employer has stated that I could be fired if the drug test results show the drugs were in my system at the time of the crash. Can I legally be fired in this situation?

I practice tort law, so I suggest you contact an employment lawyer for confirmation, but if your employer has warned against driving while taking your prescription and you drove anyway (crash or not) then unfortunately my interpretation would be that you are in violation of company rules and you can be fired. I wish you luck, and if I am misinterpreting the rules, some 'grey area' may exist. GOOD LUCK!

I agree with James's answer and would add that in Georgia, absent a contract, you can be fired for no reason at all, so cause may be irrelevant in your case. Again, I don't do employment law, so you may want to confirm this with an expert in that field.
