Missed Probation monthly report

5 views 4 answers
About 2 weeks ago I received a call from PO saying that he didn't receive my monthly probation report. I am 100% sure I sent it so I dont know why he didn't receive it. Regardless he threatened to violate me. I resent the report but this time with tracking. What will happen to me? I don't want to go to jail. Ive already completed all my community service and Im halfway done with probation

I doubt you're in any jeopardy but it depends what you're on probation for. If it's not something involving dishonesty, you're probably all right. Fax or PDF with a return receipt and don't take a 'tude with the PO.

If you sent the report and it got lost in transit, you did the right thing by resending it. Always keep a copy of documents you send. f there is a problem with snail mail, fax or email the report. You are not likely to be in trouble if you made every effort to comply.

The probation department will report the violation to the prosecutor and he will decide whether to file a Petition To Revoke Probation or not. If he does, it has been my experience that a minor violation like this is no big deal. This is what is called a technical violation. It is not a subsequent crime or a positive drug test. Most judges are not gonna do much about a situation like you have described. Treat your probation officer with all the respect and courtesy you would give a business associate. That is always be poilite, stay in touch and be on time.
