Is there any recourse? Can this be combined with the deed-in-lieu? What type of lawyer is best for case like this?

I wonder if the loan servicer that offered me a deed-in-lieu violated the Fair Debt Collection Practices Act. 1. The loan servicer called me twice to discuss a debt after I requested in writing (and they subsequently agreed in writing) prior to the call not to call. FYI: I wasn’t in default but their response to my mortgage assistance request states “this is an attempt to collect a debt.” During the call the loan mitigation worker attempted to bully me into accepting his verbal rendition of their documentation. He misrepresented the documents and threatened to report my noncooperation. 15 U.S.C. § 1692e 2. The servicer refuses to provide basic info about the deed-in-lieu and wouldn’t verify ownership of the loan. (citing 15 U.S.C. §1692g) Foti v. NCO Financial Systems. Thanks.

You really need to retain experienced mortgage foreclosure defense counsel. There are things which while they are significant to you, are not legally significant. Making statements is fine, but being able to prove your contentions is critical. Good luck.
