As a pre-startup, how can I plan to employee non-US citizens when it is unlikely I will obtain an H1-B to start?

Some of these people might be right out of college here on student visas, does that help?

The good is that a recent college graduate will probably have a 1 year OPT work permit. The bad is they have, at best, a 20% chance of getting an H. Talk to an attorney.

This seems like a challenge, since the USCIS is likely to scrutinize a start up business that can hire an H1b visa holder from the onset. The cost of such an obligation seems questionable. You should consider other visa options or business plans.. Good luck

If they have OPT they can work. As far as your H1B, make sure that's your only option.

Your question is confusing. I’m not sure if you are saying that you’ve got an employer who wants to file a petition for an H1B on your behalf, or if you plan to get an H1B so that you can start a company? To get an H1B, you must have a petition filed by a prospective employer. You cannot start a company on an H1-B, so you cannot hire anyone.
