You really will need to talk with an attorney in this situation. If there is no order for custody in place, you and the child's mother have 50/50 custody. Getting a custody order that includes a visitation plan is the best way to ensure that your daughter will have both parents in her life. If funding is an issue, you may want to seek out local pro bono resources like Legal Aid or the Creighton Legal Clinic. Attorney's at these locations may be able to give you the assistance you need.
Best of luck!
If you can't reach an amicable resolution with the other parent, then you will likely need to seek the court's assistance to get a custody order in place. You can proceed with a legal action on your own, but you are still required to follow the court's rules the same as an attorney. Sometimes family members are willing to help out with legal expenses.

You really do need an attorney in these situations. Without an order you do both still have equal rights (assuming there is not a protection order or anything of that sort in place), however, it can get ugly very quickly if the kids get used as a pawn with both of you grabbing and running with them every chance you get. You can look on the Nebraska Supreme Court website, I know they have forms for some custody issues. A lot of attorneys do take credit cards or will set up payment plans as well.
