we used coldwell banker realtor and the posting for the property mentioned 2 parking spots, the landlord only has one spot so he is asking us to park other car on the street, he doesnt reply to our calls and emails and every month sends us an email with a notice that he wil file for eviction if rent not paid by 5th of each month,
In order to answer your question definitively, a thorough review of the lease agreement would be necessary. With that being said, I suspect that it is highly unlikely that you can lawfully terminate your lease over the parking issue. You may have some recourse, but again, an attorney would first need to familiarize him/herself with the agreed upon terms. As far as the emails are concerned, your landlord is well within his/her rights to file for eviction if the rent is not paid in accordance with the lease. If you're having a hard time getting your landlord to respond to your emails/calls, I would suggest sending a letter via certified mail. Good luck.
The fact that the landlord has breached the lease regarding parking is not necessarily a basis to terminate the lease. In addition, if you can park in the street close to home at no cost, I am unclear as to the basis for a damage claim.
Review the lease agreement with a landlord-tenant attorney.
