If plat restrictions forbid a fence can I make them take it down?

My property was split and a subdivision to plat done AROUND me so I am still meets & bounds. It was part of sales agreement that plat restrictions would forbid fencing. They do state no fences. However my neighbor put one up anyway. Can I make him take it down? I fear I can't because I am not part of the subdivision.

You probably are correct, but without reviewing the restrictions it is difficult say with any degree of certainty. A real estate attorney in your area should be able to give you specific advice.

Yes, usually you would not be able to enforce covenants against another property owner unless you were also a member of the association. We would need to see the Declaration of Covenants to know for sure.
