Sidewalk Biking in Tempe, Arizona

Business 3 views 7 answers
Is it legal for bikers in the city of Tempe to bike on the sidewalk? Also, if there is a bike lane, can bikers choose to bike on the sidewalk in lieu of the Bike Lane? Thank you. Note: I did not get a bike ticket, nor I was I injured or in a bike accident. I just categorized this question in those categories so I could get the right attorneys answering.

In Tempe, there is Tempe City Code Section 7-52: http://www.tempe.gov/Home/ShowDocument?id=8704 There also a number of Arizona State laws that apply to bicycle riders. Examples of a few of these laws include: Arizona Revised Statutes Section 28-812. Applicability of traffic laws to bicycle riders http://www.azleg.gov/ars/28/00812.htm and Arizona Revised Statutes Section 28-815. Riding on roadway and bicycle path; bicycle path usage http://www.azleg.gov/ars/28/00815.htm

Tempe City Ordinance Sec. 7-52 covers this directly and states: Riding on sidewalks or bicycle lanes - (a) The city traffic engineer is authorized to erect or place signs on any sidewalk or roadway, prohibiting the riding of bicycle thereon by any person; and when such signs are in place no person shall disobey same. (b) Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and should give audible signal before overtaking and passing such pedestrian. (c) No person shall ride or operate a bicycle in any direction except that permitted by vehicular traffic on the same side of the roadway where the sidewalk or bicycle lane exists; provided, that bicycles may proceed either way where signs or pavement markings on the sidewalk, bikeway or bicycle lane appear designating two-way traffic. (d) Any person riding a bicycle on a bikeway, sidewalk or bicycle path that is about to enter or cross a roadway shall yield the right-of-way to all traffic on such roadway.
