You need to consult an attorney who handles criminal traffic cases. Reckless driving is a criminal traffic offense that can carry up to 60 days in jail and a $500.00 fine. The state musts prove that you drive in a willful wanton and reckless manor. Not sure how they could charge you under the facts you presented, but there are always at least 2 sides of each story. You need to obtain a copy of the accident report and the probable cause affidavit and consult a criminal defense attorney well before your court date. Please let me know if this answer was helpful by hitting the helpful button. Good luck.

It is in your best interest to retain a traffic attorney, preferably one that does criminal traffic cases, to deal with this situation. This is not just a traffic ticket in traffic court where if you lose you pay a fine. A reckless is a criminal offense and you do not want to be caught off guard in dealing with this situation walking into court thinking you get to tell your side and its over with. These cases are governed by strict rules of court. Additionally, improper handling of the criminal traffic case may not just expose you to a potential (probably unlikely if no other offenses, but still possible) jail sentence also cause harm on any civil case coming, including causing issues for your insurance. This is a manageable and remediable situation if the facts you state bear through, but only if you have someone that knows what they are doing to guide, assist, and advise you. The money spent on an attorney could easily be saved when you compound the costs and problems of an unwarranted (speaking in general and not an opinion on your case) reckless conviction.

These types of accidents often result in the last vehicle being ticketed. It's a challenge, but finding an attorney to fight it will give you a better chance. Reckless driving is a serious charge, a criminal traffic offense. When I handle these it's always fight, but you can usually find some positive result.

Reckless driving is a misdemeanor (a criminal) offense. You have a mandatory court hearing and will be appearing opposite a prosecutor who, if you are convicted, can argue for up to 60 days in jail. You may or may not enjoy viable defenses to the charges, affirmative or otherwise, or there may be factual, legal, procedural or substantive mechanisms by which to attack and beat the charges in your unique case, I do not know and the forum to find out is NOT on line; rather it is in the sanctity of attorney's offices, where your statements are privileged and cannot be used against you. The best way for you to get competent advise is going to be to consult with an experienced and local criminal defense lawyer who can follow-up on your information with questions of her/his own, as well as review the police reports and whatever evidence that you may provide and then offer an informed opinion. My advise: Get offline and into a skilled and experienced J-ville area criminal defense lawyer's office. Use the "Find a Lawyer" feature on to locate proximate lawyers, make an appointment, show up on time, bring whatever evidence, documents or witnesses that you may have, engage in a meaningful face-to-face consultation and get yourself some advise which is legally sound and has been custom tailored as possible to meet your specific reasonable needs in your unique case. I hope that I have been helpful in answering your question.

It sounds more like a careless driving charge so you should attempt to get the charge reduced. There is a larger burden to prove reckless driving.
