What can I do if I have a dispute with my roommate over a shared property?

My roommate and I own a dishwasher together. I purchased the dishwasher from the store and he paid me his share. Our relationship went down over time and now I'm leaving the place and I'd like to take the dishwasher with me. He wants to buy it from me and I'm not interested. I'd like to pay his share and take the dishwasher. Today, I saw that he has locked the dishwasher with a chain, so that I cannot move it! I'd be thankful if you let me know what my options are.
I suppose you could file a Small Claims against him for half the value of a used washing machine (which wouldn't be much, as the courts do not award replacement value, but rather the value of the item in used condition). But ask yourself; do you really want to spend your time and energy arguing over half the value of a used washing machine? I wouldn't. I would advise my client to try to work out a deal, and if that is not possible, then walk away. Good luck with this troublesome problem.

Well, you aren't likely going to get the dishwasher back by going to the courts. You would probably get money, but you never know. If you want to file a small claims lawsuit, you can. You have a receipt, so the facts are in your favor. However, the lawsuit will take a long time. You will probably be moved out by then. You'd also have to spend money to get money, in Court. So, as a practical matter, your best bet is to talk to your roommate. Think of creative ways to satisfy their need. Explain that you understand his or her situation. Maybe you can find a dishwasher replacement that they like and have it installed for them, if they reimburse you for the replacement? Would this help? I'm not sure that there is any perfect solution, but listen to your room mate carefully. Find out what they want, their "real" needs. Is it the bother of having another one installed? Is it that they are mad at you for leaving and they need some sympathy and a heartfelt apology? Is it the only dishwasher they like and this is the only one left around? In the end, give them what they want. It might not be the dishwasher or money. Then, try to receive, (in hand) as much money as you can from the roommate to reimburse you of your half (including warranty and installation fees). Then, buy your own dishwasher. The Sears outlet in Framingham has good discount dishwashers. Does this help? I'm so sorry you have to deal with such behavior. But when things get weird, sometimes its not the object of contention that's the problem. It's something else, like an apology or feelings of being treated unfairly.
