Is victim worth pursuing a case against someone for monetary damages if person charged is jobless and broke?

I have a confused friend who is the victim of a crime where she can sue for monetary damages but the person to be charged is unemployed, and I guess will continue to be jobless for a long time. Is it worth the time, effort and attorney's fees to pursue a case?

The judgment will always be there in case he gets a job later on. And the judgment can be renewed every 5 years. However, that does not mean it is worth the effort. A lawyer who hears the details from you might be able to give you a better idea.

It depends on the nature of the judgment. If it's eligible for discharge in bankruptcy, it may not be worth it. However if it's for an intentional tort or a type of restitution, it may be. Your friend should consult directly with a litigation attorney to discuss the facts of her case.

There is not enough available to provide a full analysis. Your friend should talk to a lawyer about the specifics. In addition, if there is a criminal proceeding, your friend can talk to the prosecutor about restitution through the criminal process.
