If we divorced within the next 8 years, am I entitled to alimony or any future inheritance in a no fault divorce?

My husband's father has his inheritance split between properties (houses) and an account (cash) all set up during the time we've been married. He's currently 32yo and will not have any access to anything until he is 40yo. He and a sister will get an equal amount of property and cash. This is all set up in the state of Missouri and we live in Illinois. We've been married 3 years. He says he works to take care of me and our retirement so I only work part time for now to take care of my kids.

The question of alimony (maintenance) will depend upon many factors, including the length of your marriage, your income at that time, and his income at that time. There is no way to predict your circumstances 8 years into the future. As to inheritance, and inheritance received during the marriage will be considered non-marital property, unless the inheritance is place into some form of joint ownership. This is a simplified explanation, as this can be a complicated issue dependent upon the facts of your situation. If yo are divorced after 1/1/2016, fault will not be an issue.

Sorry to hear that you are not happy in this relationship. I agree with prior Counsel. Alimony has many factors that are considered before an award is granted. Good luck.

I'm sorry, but it is impossible to determine what your rights to alimony will be in eight years. As to what he receives from his father, it will be your husband's non-marital property unless he puts your name on title, or puts it in an account with your name on it
