Got an underage DUI for blowing a .074 (field test) and then blowing a .05 (after arrest). What are my chances of a deferral?

I have an otherwise clean record except for a fail to yield that i had taken care of about two years ago. I am a 19 year old female and very active in the community. I am also a college student with a 3.82 GPA. What are my chances of getting Deferred Imposition of Sentence? I've spent a lot of time building the image that I want to make for myself and would like to not have this mistake end up on my record. Also, what other pleas would help this not affect my insurance? as the spike in insurance and it being on my record forever are my biggest concerns.

Good question. I am not licensed in Montana, so my answer is to rely upon the answer of an experienced DUI attorney who practices regularly in Bozeman in particular. A lot of the answer will depend upon the local court's approach on these types of cases, the facts of the case and the experience of your attorney. Hire a good DUI attorney with experience.

Use the "Find a Lawyer" tab at the top of the page to consult with an attorney in your area. They will be in the best position to advise whether a deferral is possible in your situation. Good luck.

Chances are not great. However, that doesn't mean you can't beat this charge. Some prosecutors will look at your personal information and still cut you a deal. This is something we do all the time, so check my profile if you would like a free consultation from a Montana DUI defense attorney.
