What do you advice a woman to do? She knows that she hires a lawyer to file for child support; she will not get a dime because it cannot be enforced outside the United States? She knows that the only thing the courts can do it order the father to pay child support issue an arrest warrant if he does not and take away his US passport if he owns more than $2,500.00 in child support. She knows that the US government cannot revoke the Brazilian passport the father of her child has and he is believed to be living in South America. Her child was conceived in California.

You may be in trouble collecting support. You might have to do it in South America but you have no way to even know where he is living. You should speak to a lawyer who is experienced in Hague Convention areas since this is an international problem and not restricted to California or wherever you are living. I wouldn't worry a lot about hiring a lawyer if I were you. He isn't paying support now so what difference does it make if you hire a lawyer-you still have the same collection rights whatever they are.

Are you this woman? This "father" you write about seems to be just a "sperm donor" for your precious child... a gift to you. So, why share this gift, this precious child with a person who has abandoned you, the child and cleverly hides himself in another country ... certainly not a real man since he won't support the baby, his blood? Do you really need a sperm donor in your child's life? If you don't open the Court's door of support, you never have to worry about him trying to take your child away. Think about it.

That depends on what your objective is. Is it to obtain support in hand, or can you wait and collect over time? If the amount were high enough and a court would terminate his rights if asked, would he trade his rights for a waiver of arrears? Just not enough information about what you want.
