Employee liable for company credit card debt?
Anonymous3 views1 answers
i was issued a credit card by my employer (small business) 3 years ago and just got a phone call from the collections saying that i am liable for that debt since the card had my name even though i did not give my ss# or anything when receiving the card. will this go on my credit as per what the collection agency is saying? i haven't got anything in writing about this debt yet? The credit card account does not even show up on my credit report.
In general terms, the question you must answer is were you obligated by contract with the creditor for the debt, or were you just an authorized user of the business account. If you were merely an authorized user, you may not be liable for the debt to the creditor.
Since I am not your attorney, I am prohibited from given you advice on how to proceed, but I can give you general information on the collection process. You should have recently received a disclosure from the debt collector. This disclosure instructs you how to verify, or dispute the debt, but you must take advantage of this within 30 days.
There are additional defenses to these actions that a consumer lawyer in your area may discuss with you if you choose.
