I'm the sole custodial parent, I recently put in an RFO to relocate out of state. If for some reason the request is denied, Can I lose custody, Even if I choose not to relocate ?

The court must assume you will relocate but can fashion an order commencing with the move such that if you don't move there would be no change of custody.

Before a move takes place, there is usually an evaluation to determine which parent children should reside with AFTER the move takes place. If the court determines that the children should not go with the moving parent, it is common for orders to include a parenting arrangement for the before the move and after the move time periods. When the staying parent time share has been much less than the moving parent, a court can structure an increasing time transition to the staying parent as well. It can be difficult to "take back" a move away request if the children are not allowed to relocate (the moving parent then looks like the move was intended to reduce the other parent's time, rather than for a legitimate reason), but it is possible to change your mind and put the old plan back in place.
