What are my rights

Business 3 views 2 answers
My daughter was born out of wedlock but her father and I got married the following year. He and i haven't been together for 2 years but he is now threatening to take her away from me because he dislikes my new boyfriend. I'm far from an unfit mother. I have my own job and car and have no criminal background. So I don't know what reasons he could use to get custody of my daughter other than me having another child while still legally married. I just want to know what are my rights and what can I do legally?

There are several problems with your fact pattern... 1. Get a divorce. 2. Establish custody and child support. 3. Stop dating while you are married. Having a child by another man while you are married might be an influencer in the determination of custody. Having boyfriends, having other men sleep over, etc. could easily be an indication that you provide an unfit moral environment for the child. Most custody order specifically prohibit this kind of behavior for the protection of the child. Get an attorney and settle your relationship with your husband legally. David

You have the right to file for divorce and petition the court for custody, child support and an equitable distribution of assets. I recommend you consult with an attorney on this.
