Question about the "preference classification" on the form I-797C (notice of action)
Anonymous2 views3 answers
I just got the form I-797C, notice of action, regarding a petition for alien relative (green card) coming from my stepfather who's a US Citizen. However, while my mom's letter has "spouse of US C" under the "preference classification", mine says "unknown classification". Should I be worried about something? Thank you.
This is a receipt notice, I assume. It would be nice if it had a proper category listed. If you were here in the office I would ask you how old you were when they were married and how old you are now. The answers to those questions will have a bearing on how the case goes from here.
It might be nothing and might be cleared up by the time you receive a biometrics appointment notice. On the other hand -- without reviewing the matter, you might not be eligible as a beneficiary of your step-father's petition. These are things an attorney should check before you file papers not after. Then again maybe you did look into all of that ahead of time and it may be a non-issue.
If you have received the receipt notice from USCIS, I would not be concerned as to the lack of preference classification. Once you obtain the approval, you should check the preference classification carefully to ensure that it is accurate.
