I have been concerned parent and very involved parent in my child's education, my daughter has ADHD with hyperactive to be compliant with her medication we need to have a behavioral assessment done since the beginning of school and still is not done. On Wednesday my daughter had behavioral issues at school and the school did not inform my husband or I until after school. which that day no one said that my daughter had complained about her neck and the police department should up at our house to look at my daughters neck ( the police officer stated that the school called it in) The next day my daughter told me that she could not talk to us about school, and when I went in on Thursday to talk with the school to talk with them they told me that I as a parent don't have any rights.

I do not practice in Nebraska but I can nonetheless say that it is not true the you "don't have any rights." You most likely have rights under your state child welfare and special education laws and you certainly have rights under the federal Individuals with Disabilities Education Act and Family Education Rights and Privacy Act. Even though I do not practice in Nebraska, I am also fairly confident in saying that you would very likely be unsuccessful in suing your daughter's school for reporting suspected child abuse to the police, for not informing you about your daughter's incident or complaint or for not talking to you about their report. You MIGHT have more success in pursuing dispute resolution processes regarding the school's failure to conduct the behavioral assessment or for them inadequately dealing with your daughter's ADHD-related special needs. If you want to pursue issues regarding the police visit, you should use the Find a Lawyer function here on attorneyqna.com to seek out a Child Abuse lawyer in Merrick County or Grand Island. If you want to pursue issues around getting your daughter the behavioral assessment so that her individualized education plan can better address all of her education and special education needs, you should use the Find a Lawyer function here on attorneyqna.com to seek out a Special Education lawyer near Central City. If you want to be sure I am not missing anything in my assertion that you would not be successful in a lawsuit about the incidents you described, you should use the Find a Lawyer function here on attorneyqna.com to seek out and have a detailed consultation with a personal injury lawyer in your area.
