I have received noise complaint letters but i have already installed carpets .

Tenants from downstairs hit my floor from their ceiling whenever i drop something or my kids play jump and run sometimes. I feel like they are trying to intimidate us and i have to walk on eggshells in the hours of the afternoon. My child has autism so he screams and jumps for stimming purposes. How can i protect myself from anything ? I feel the banging from downstairs is uncall for.

Dear Far Rockaway Tenant: Were the noise complaint letters from the landlord or from the neighbor? If from the landlord, the landlord has the right to follow up another tenant's complaint about noise, but the "noise" must be considered a nuisance or your tenancy as objectionable. Generally, NYC Housing Court will not consider a tenant as a "nuisance" if noise comes only during the daytime. If the letters are from the neighbor only, let your lawyer correspond with the neighbor and demand the neighbor cease the behavior of banging on the ceiling.
